Why you Should use a Real Estate Lawyer

Purchasing a home is probably one of the most significant purchases you can make, and as such it is important for the process to be as smooth and stress free as possible.

Due to the scale of the purchase, real estate involves its own laws, which are unique and can raise certain issues not present in other transactions. A real estate lawyer is trained specifically to deal with these transactions and will ensure an efficient, problem free transaction.

Whether you’re buying or selling we always advise that you engage the services of a Realtor and real estate lawyer. The Realtor will help you find the right house, or the right buyer and negotiate the price, while the lawyer will ensure that your rights are protected and duties clearly defined.

What does a real estate lawyer do?

A real estate lawyer has a number of responsibilities depending on whether you are buy or selling. We spoke to Tom Docking and Ralph Yetman, two Whistler real estate lawyers who we regularly work with to find out more details:


When purchasing a home the lawyer is there to help you understand the purchasing contract and ensure that you receive valid ownership, subject only to any conditions you have accepted.

With the amount of paperwork required when buying a home, it can be a lot to take in. Your lawyer will review all documentation and check that there is nothing to impeded your purchase or use of the property. They will also attend the closing and go over everything you are required to sign.


If you are selling a property the lawyer will prepare the purchasing or sale agreement, along with negotiating the terms.

Along with also attending the closing and reviewing the paperwork, your lawyer will arrange the transfer of security deposits and any insurance certificates.
